🚨 46 HOMEOWNERS. TWO MAPS. ONE VERY SERIOUS QUESTION.
How would you feel if land shown in your title deeds — land you had paid to maintain for 20 years — was treated as available for a private developer?
That is what residents of Fairway View, Prestwick say is happening with Northcare's 60-bedroom care-home development.
And Lorna Helton and Shona Bain say they can prove why serious questions need answering.
They have title deeds, maps, planning documents, emails, photographs, video, audio recordings, witnesses and a Police Scotland reference.
LOOK AT THE TWO MAPS.
The residents' title-deed plan shows their privately owned garden ground at the entrance to Fairway View.
Then look at the map reproduced in UNUM Partnership's development documentation.
Residents say something extraordinary has happened:
THE FOOTPATHS APPEAR TO HAVE BEEN FLIPPED.
They say the actual adopted footway is on the opposite side of the road, while the UNUM material identifies the strip corresponding with residents' garden ground as adopted footway.
And they didn't discover this after permission was granted.
They raised the ownership problem at the May 2023 consultation.
Yet SAC subsequently relied upon Ayrshire Roads Alliance advice that the disputed verge was adopted, and planning permission was granted.
At the recorded Council meeting, when officials discussed checking the List of Public Roads, the residents responded:
“I think they misunderstood which side of the road it was.”
THEN THEIR FENCE WAS CUT DOWN.
On 28 January 2025, contractors arrived at the disputed land.
Residents say the contractors told them they had been sent by Northcare.
They have photographs of the works and destruction.
They contacted Police Scotland: PS-20250128-1791.
And in the later recorded Council meeting, Bain recounted Northcare director William Sawers telling her:
“I instructed them to do it.”
That is Bain's recorded account of his statement and should be answered directly by Northcare.
THEY TOOK THE EVIDENCE TO THE TOP.
Helton and Bain repeatedly requested a meeting with SAC Chief Executive Stephen Penman.
They told him explicitly:
“We have factual evidence, audio and video recordings, witness statements, a police number…”
Penman declined the requested meetings, explaining that the allegations first needed to be provided in writing to create an auditable record.
They even offered to meet on site, by video or by conference call.
NOW CONSTRUCTION IS DUE TO BEGIN.
Residents encountered contractors on 14 August 2026 and say they were told construction would start Monday 17 August.
So before another piece of this disputed land is touched:
PUT THE TWO MAPS SIDE BY SIDE.
WHO OWNS THE LAND?
WHERE IS THE REAL ADOPTED FOOTPATH?
WHO PRODUCED THE MAP THAT RESIDENTS SAY PUTS IT ON THE WRONG SIDE OF THE ROAD?
AND WHAT LEGAL RIGHT DOES A PRIVATE DEVELOPER HAVE TO USE LAND IF IT REMAINS IN THE TITLES OF 46 HOMEOWNERS?
Now imagine it was YOUR garden.
You have the deeds.
You've maintained it for 20 years.
You've repeatedly produced evidence.
Your fence has been cut down.
And the builders are arriving.
HOW OUTRAGED WOULD YOU BE?
46 Fairway View homeowners say they have the evidence.
South Ayrshire Council now needs to answer it.
