DISCLAIMER, TERMS/ CONDITIONS: Custom Products/Shutters/Blinds/Shades
Custom
Products are made products such as shades, blinds, shutters, roller shades, etc. are fabricated to your specifications and NO REFUNDS or exchanges are possible. Custom purchases made through our consultation service require a minimum 50% deposit at time of order. Custom orders cannot be cancelled, and deposits cannot be refunded, once products are ordered, are usually placed into production within 24 hours of receipt of deposit. Because shutters/blinds/custom shades are assembled to order in over 800 sizes it is unlikely they could be resold or reused if returned. Therefore, shutters are not returnable nor can orders be cancelled once production has begun. We do not offer refunds on custom shutters. Please keep in mind that there may be a time delay because of holidays or shipments of supplies or backed up orders. Please contact us to resolve any issues. If there is a defect in material or workmanship or we made the wrong size, we reserve the right to repair your window coverings or resolve the problem BEST AS POSSIBLE. Liability Waiver:
Sunset Shutters and Shades is not responsible for negligent misuse or injury when using our installed products. With intention of proper use, no such accident should occur when operating ANY window coverings or window blinds installed by Sunset Shutters and Shades. We reserve the right to waive all liability of installed products and reserve the right to perform a proper and thorough inspection of said incidents. In no event shall Sunset Shutters and Shades and any 3rd party associated with the company be responsible for such losses or medical bills and or death from mis-use. Shipping Charges:
Please note that shipping charges to the clients location are non-refundable. The customer pays the shipping for return items. All Returned Merchandise Must be in Original Condition and with the original packaging. All items are carefully inspected upon receipt. Color Variations:
Please note that the appearance and color of fabrics, window treatments, and other accessories can vary from computer monitor to monitor, and actual fabric color may also be different hue as each dye lot differs slightly. Color may vary on the final product and MAY OR MAY NOT MATCH 100% in variation. Warranty:
Sunset Shutters and Shades is able to provide high quality window treatments which if cared for and used properly, should last many years. Our products are covered by manufacturer warranty. In general, fabric treatments, both custom and ready-made, are covered for one year against fabric and fabrication defects. Sunset Shutters and Shades cannot warranty against damages caused by misuse or abuse of our products. Warranties apply to the original customer and /or installation with proof of purchase and covers any defects in materials or workmanship provided the product is measured and installed according to the product instruction. If warranty service is needed contact us and we will arrange for repair or replacement as quickly as possible. We reserve the right to determine if your item warrants a repair or partial replacement of any parts or in the unlikely event the entire piece is defective, it will be handled accordingly. Service will be done on the original products orders according to invoice. Sunset Shutters and Shades warrants that any installation rendered by the company during such time shall be performed in a professional, workmanship like manner with the care and skill. This installation warranty shall not apply if anyone other than Sunset Shutters and Shades has tampered with, improperly repaired or re-worked the installation in any material respect. Nor shall the installation warranty apply to any installation that has been modified or improperly handled, stored, installed, repaired, operated, used or maintained in any material respect. Payments:
Final payment must be paid in cash, check or authorized charge slips made payable to Sunset Shutters and Shades. The installer is not authorized to accept any final payment. All final payments must be made before the installer leaves the premises. There will be a $35.00 charge for all returned checks. All additional expenses incurred by Sunset Shutters and Shades for collecting unpaid invoices will be at the customer's expense, including but not limited to attorney's fees. Upon payment of your deposit you understand that you are entering into a legal contract. Any changes to the specifications of the invoice must be requested and agreed by both parties in writing. Also by making such deposit you understand that the order is for custom merchandise and cannot be cancelled once ordered. If customer fails to make final payment, Sunset Shutters and Shades shall be entitled to demand the entire balance due immediately and take all legal actions necessary to collect the debt. Any and all cost of collecting the debt shall be added to the amount owed under this contract.
